OVERVIEW
Welcome to Laser Marks. The terms “we”, “us” and “our” refer to Laser Marks. We operate this website and online store and provide custom laser engraving, personalized products, ready-made products and related services (the “Services”). Our online store is powered by Shopify.

These Terms of Service (“Terms”) govern your use of our website and your purchase of products or services from Laser Marks. By accessing our website, placing an order, requesting custom work or otherwise using our Services, you agree to these Terms together with our Privacy Policy, Refund Policy and Shipping Policy.

Nothing in these Terms is intended to limit any rights or remedies that cannot legally be excluded under applicable consumer protection laws.

SECTION 1 - USE OF OUR SERVICES
You may use our website and Services only for lawful purposes. You agree to provide accurate, complete and current information when placing an order, requesting a quote or communicating with us.

You are responsible for maintaining the confidentiality of any account credentials and for activity occurring through your account.

SECTION 2 - PRODUCTS AND CUSTOM ENGRAVING
Laser Marks offers both ready-made products and products that may be customized, personalized, engraved or produced according to customer specifications.

We make reasonable efforts to display and describe products accurately. However, actual colours, shades, textures and finishes may vary depending on the material, manufacturing batch, natural characteristics of the product, engraving process, lighting and the screen used to view the product.

Laser engraving is a physical process that permanently changes the surface of a material. Results may vary between different materials, coatings, colours and individual products. Minor variations that are inherent to the material or engraving process are not necessarily considered defects.

We reserve the right to modify or discontinue products, materials, options or services and to limit quantities when reasonably necessary.

SECTION 3 - CUSTOM ARTWORK, LOGOS AND CUSTOMER-PROVIDED CONTENT
You may provide names, text, photographs, logos, artwork, graphics, design files or other content for use in producing a custom order.

By providing content to Laser Marks, you confirm that you own the content or have the necessary permission, licence or authority to use it and to authorize Laser Marks to reproduce or engrave it for your order.

You remain responsible for any copyright, trademark or other intellectual property rights associated with content you provide. Laser Marks is not responsible for claims resulting from unauthorized use of artwork, logos, trademarks, photographs or other content supplied by a customer.

You grant Laser Marks a limited right to use, modify, resize, convert or otherwise process the supplied content only as reasonably necessary to prepare, produce and fulfill your order and provide related customer service.

We reserve the right to decline any artwork or engraving request that we reasonably believe may violate applicable law, third-party rights or our policies.

SECTION 4 - DESIGN PROOFS AND CUSTOMER APPROVAL
For some custom orders, Laser Marks may provide a digital proof, layout or other preview before production.

Customers are responsible for reviewing all names, spelling, dates, numbers, text, positioning, logos, artwork and other customization details before approval.

Once a proof or design has been approved, Laser Marks may begin production based on that approval. Changes requested after approval may not be possible and may result in additional design, setup or production charges.

Laser Marks is not responsible for errors that were present in information, artwork or a design approved or supplied by the customer. If Laser Marks produces an item differently from the approved design or submitted specifications due to an error on our part, please contact us so that we can evaluate and correct the issue.

SECTION 5 - CUSTOMER-SUPPLIED ITEMS
Laser Marks may, at its discretion, agree to engrave an item supplied by a customer. Acceptance of a customer-supplied item does not guarantee that the material or coating will produce a particular engraving result.

Some materials, finishes and coatings react unpredictably to laser engraving. We may require testing before proceeding and we reserve the right to decline an item that we believe may be unsuitable or unsafe to engrave.

Customers should not provide irreplaceable, highly valuable or sentimental items without discussing the item with us in advance. Laser Marks is not responsible for pre-existing damage, hidden defects, material inconsistencies or manufacturer coating defects that become visible during normal engraving or handling.

SECTION 6 - ORDERS
By submitting an order, you are offering to purchase the selected products or services subject to these Terms. We reserve the right to accept, decline or cancel an order where reasonably necessary, including because of product availability, pricing errors, technical problems, suspected fraud, inability to complete the requested engraving or other legitimate business reasons.

If we cancel an order after payment has been processed and no amount is otherwise properly payable for completed custom work, we will issue the applicable refund to the original payment method.

Please review all order information carefully before completing your purchase. Because many Laser Marks products are customized specifically for each customer, changes and cancellations cannot be guaranteed after an order has been submitted.

SECTION 7 - BUSINESS AND BULK ORDERS
Laser Marks welcomes orders from businesses, organizations, contractors, promotional companies and other commercial customers.

Additional terms, pricing, setup fees, production requirements, minimum quantities or payment arrangements may apply to custom quotes, bulk orders or business orders. Where a written quote or separate agreement contains terms that differ from these Terms, the specific terms of that quote or agreement will apply to that order to the extent of the difference.

SECTION 8 - PRICES, PAYMENTS AND TAXES
Prices are displayed in the currency indicated on the website or at checkout. Applicable taxes, shipping charges and other costs will be shown where required before the order is completed.

Prices may change without notice, but a price change will not normally affect an order that has already been accepted, except where there is an obvious pricing or technical error.

You agree to provide accurate billing and payment information and confirm that you are authorized to use the payment method provided. Payment transactions may be processed by Shopify and other payment service providers.

SECTION 9 - DISCOUNTS, SALES AND PROMOTIONS
Discounts, promotional codes, sale prices and special offers may be subject to additional conditions, expiration dates, minimum purchase requirements, product restrictions or other limitations.

Unless specifically stated otherwise, discounts and promotional offers cannot be combined with other discounts, promotional pricing, sale pricing, clearance pricing or special offers.

We reserve the right to correct or cancel a discount that has been applied contrary to the stated conditions of the promotion or as a result of an obvious technical error.

Sale, clearance and promotional items are subject to the conditions described in our Refund Policy.

SECTION 10 - SHIPPING AND DELIVERY
Processing or production time for custom products is separate from shipping transit time. Delivery estimates provided at checkout or by a carrier are estimates and may be affected by circumstances outside our reasonable control.

Customers are responsible for providing an accurate and complete shipping address. Additional information regarding shipping, tracking, delivery delays, damaged shipments and international orders is available in our Shipping Policy.

SECTION 11 - RETURNS, REFUNDS AND CANCELLATIONS
Because custom engraved and personalized products are produced specifically for an individual customer, different return and cancellation conditions apply to these products than to standard ready-made products.

Returns, refunds, exchanges and voluntary cancellations are governed by our Refund Policy.

If you need to request a change or cancellation, contact us as soon as possible at info@lasermarks.ca. Cancellation or modification requests are not guaranteed and will be evaluated based on the status of the order and any work already completed.

Nothing in this section limits cancellation, refund or other rights that a consumer may have under applicable law.

SECTION 12 - ERRORS, INACCURACIES AND AVAILABILITY
Occasionally, our website may contain typographical errors, inaccurate product information, incorrect pricing, incorrect shipping charges or other errors.

We reserve the right to correct such errors and update information. If a material error affects an order that has already been submitted, we may contact you to explain the issue and, where appropriate, provide an opportunity to proceed under the corrected terms or cancel the affected order.

SECTION 13 - LASER MARKS INTELLECTUAL PROPERTY
Unless otherwise stated, the Laser Marks website and its original content, including text, photographs, graphics, product images, designs, branding, logos and website elements created by or for Laser Marks are owned by or licensed to Laser Marks and are protected by applicable intellectual property laws.

You may view and use the website for personal or legitimate business purchasing purposes. You may not reproduce, distribute, copy, republish or commercially exploit our original website content without permission, except where permitted by law.

This section does not give Laser Marks ownership of customer-provided logos, artwork, photographs or other intellectual property submitted for custom production.

SECTION 14 - THIRD-PARTY SERVICES AND LINKS
Our Services may rely on or contain links to third-party services, including Shopify, payment processors, shipping carriers, analytics providers and other service providers.

Third-party services may have their own terms and privacy practices. Laser Marks is not responsible for the operation, availability or content of third-party websites or services that we do not control.

SECTION 15 - SHOPIFY
Our online store is powered by Shopify, which provides the ecommerce technology that allows us to offer products and services online.

Purchases made from Laser Marks are transactions between you and Laser Marks. Shopify provides ecommerce and payment-related infrastructure but is not the seller of Laser Marks products.

SECTION 16 - PRIVACY
Your personal information is handled in accordance with our Privacy Policy.

Because our store is powered by Shopify and may use other service providers, certain personal information may also be processed by Shopify and other providers as necessary to operate the store, process transactions, fulfill orders and provide related services.

SECTION 17 - PROHIBITED USES
You may not use our website or Services to violate applicable law, infringe intellectual property rights, transmit malicious software, interfere with website security, attempt unauthorized access, collect personal information unlawfully, engage in fraud or misuse our Services in a manner that could harm Laser Marks, our customers or third parties.

We may restrict or terminate access to the Services where we reasonably believe these Terms have been violated.

SECTION 18 - DISCLAIMER
We make reasonable efforts to provide accurate information and quality products and services. However, except for warranties or rights that cannot legally be excluded, the website and Services are provided on an “as available” basis.

We do not guarantee that the website will always operate without interruption or technical errors. Product photographs, digital proofs and screen previews are representations and may not perfectly reproduce the appearance of the finished physical product, particularly where natural materials, coatings or laser engraving are involved.

SECTION 19 - LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Laser Marks will not be liable for indirect, incidental, special or consequential losses arising from use of the website or Services where such liability may legally be excluded.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law or limits any mandatory rights available to consumers.

SECTION 20 - INDEMNIFICATION
You agree to be responsible for claims, losses or reasonable costs arising from content, artwork or materials that you provide to Laser Marks where the claim results from your infringement of a third party's intellectual property rights or your violation of applicable law.

This provision applies only to the extent permitted by applicable law.

SECTION 21 - SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will continue in effect.

SECTION 22 - GOVERNING LAW
These Terms and your use of the Services are governed by the applicable laws of the Province of British Columbia and the federal laws of Canada applicable in British Columbia, without limiting any mandatory consumer rights that may apply based on your location.

SECTION 23 - CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business practices or legal requirements. The current version will be posted on this page together with the date of the most recent update.

Changes will apply from the effective date stated in the updated Terms and will not retroactively change the terms applicable to a completed purchase except where required by law.
